WATER LAW

The use and exploitation of South Africa's scarce water resources is controlled by various pieces of legislation enacted by national, provincial and local government. These laws regulate a wide range of water-related matters, including the granting of entitlements to construct dams and store water, the taking or abstraction of water from surface and subterranean resources, measures to prevent pollution, and negative impacts on the flow and integrity of rivers and other watercourses. Our clients include individual water users, water user associations, irrigation boards and members of the public impacted by the unlawful use and exploitation of water resources. Our services include:

  • Advising on the scope and validity of existing water use entitlements;

  • Advising on, and process management in respect of applications for new water use entitlements and amendments of existing entitlements;

  • Liaison with regulatory authorities on behalf of existing- and potential water users and parties affected by such use;

  • Drafting of submissions in support of water use applications, objections against water use applications, and appeals to the Water Tribunal;

  • Representing clients in water-related litigation.
